General Conditions of sale of the accompaniments

Article 1 : Object and Field of Application
The present General Conditions of Sale (‘GTCS’) regulate the contractual relationship between Equiconnexion and its customers (hereinafter referred to as “the Customer”) in connection with the subscription to the different support formulas proposed. Any order implies full and complete acceptance of these terms and conditions.

Article 2 : The Support Formulas
Equiconnexion offers three forms of accompaniment with an annual subscription (12 months). Once the form is selected, the Customer agrees to comply with this formula for the entire duration of the annual commitment, without the possibility of modification in the course of the year.

Article 3 : Prices and Terms of Payment
The prices of the formulas are set to the signing of the contract for a period of one year. Payments are made monthly, in the beginning of the month, by bank transfer. All prices are in euros and are net of fees, unless otherwise stated.

Section 4 : Annual Commitment and Termination
The contract is concluded for a period of one year minimum, and the Customer may not change the formula during this period. In case of early termination of the subscription by the Customer before the end of the year of engagement, a last month’s payment will be due. This payment is intended to balance the difference between the benefits received and the amounts already paid. It allows you to cover the services to which the Customer has had access to and including the annual value exceeds the amount paid up to the date of termination.

Article 5 : Termination Procedures
The subscription is taken out for a fixed term of 12 months and shall terminate automatically at the expiration of that period without any action on the part of the Client. However, the Customer has the option to renew their subscription for a further period of one year, subject to the signing of a new contract, and taking into account any adjustments to the tariff applicable at the time of renewal. In the event of early termination, the Customer shall notify the termination request in writing (email or postal mail) subject to a notice period of one month. The notice shall take effect on the date of the receipt of the termination request. The Client agrees to pay for the extra month in accordance with article 4.

Article 6 : Right of Withdrawal
in Accordance with the regulations in force, the Client has a right of withdrawal of 14 days from the date of signature of the contract ofcover, without having to justify any reason or to incur penalties. The repayment of sums already paid will be carried out within 14 days of the notification of the withdrawal.

Article 7 : Obligations and Responsibilities of the Client
The Client agrees to participate actively in the provided guidance and follow the instructions provided by Equiconnexion. It is the responsibility of the Customer to ensure that it has the material and logistical resources necessary to track the accompaniments (internet connection, computer equipment, etc).

Article 8 : Obligation of Means
in Accordance with the regulations applicable to the business of the sport, Equiconnexion is subject to an obligation of means and not of results. This means that Equiconnexion undertakes to implement all the resources and skills necessary to accompany the Customer in the achievement of its objectives, with no guarantee of a specific result. The success of the accompaniments will depend on the personal involvement of the Client and external factors that Equiconnexion can’t control.

Article 9 : Force Majeure
Equiconnexion cannot be held responsible in case of delay or non-performance of its contractual obligations arising from an event of force majeure, as defined by the French courts. In the event of the occurrence of such an event, Equiconnexion undertakes to inform the Client as soon as possible.

Article 10 : Intellectual Property
All the elements made available within the framework of the trimmings, including but not limited to, educational materials, videos, documents, and other resources, are the exclusive property of Equiconnexion. Any reproduction, distribution or use without prior permission is strictly prohibited.

Article 11 : Amendment of the GTC
Equiconnexion reserves the right to modify at any moment the present general terms and conditions. The new terms and conditions will be applicable to any new subscription, but will not be applied retroactively to current subscriptions.

Article 12 : Applicable Law and Disputes
these terms and conditions are governed by French law. In the event of a dispute, the parties will endeavour to find an amicable solution. Failing agreement, the dispute shall be brought before the competent courts, the Court of Lille. The Customer is informed of the possibility of using, in case of dispute to mediation proceedings of the consumption in accordance with article L211-3 of the Consumer Code, the coordinates of which are to request to Equiconnexion.

Article 13 : Privacy and Data Protection
In the framework of its benefits, Equiconnexion is required to collect personal data of the Client (name, surname, contact details, health information, etc). These data are collected and processed in accordance with the regulations in force and in particular the General Regulation on Data Protection (RGPD). The data of the Client are used only for the management of the accompaniments and shall in no case be passed on to third parties without the explicit consent of the Customer. The Customer hasa right daccess, rectification and deletion of his personal data by sending a written request to Equiconnexion.

Article 14 : termination of Individual Sessions
If the Client subscribed to individual sessions as part of his cover, he agrees to prevent Equiconnexion of any cancellation or postponement of the meeting at least 24 hours in advance. In case of late cancellation (less than 24 hours before the meeting) or unjustified absence, the session will be charged or believed to be due, except in cases of force majeure or exceptional circumstances, subject toan appropriate justification.

Article 15 : Limitation of Liability
Equiconnexion can not be held responsible for any injuries, accidents or other damage suffered by the Customer in the course of the practice of sports or horse riding. The Client is required to provide a medical certificate of no contraindication to the practice of sports and equestrian prior to the start of theaccompaniment. In addition, Equiconnexion disclaims any and all liability for the outdoor activities to the practice of sports or horse riding by the Customer during the time ofproviding direct care, as well as for injuries or damage caused outside the scope of its services. The Customer is responsible for upholding the safety and kindness in his practice.

Article 16 : Temporary Suspension of the Subscription
In case of medical reasons or force majeure (for example : injury, illness, family events unforeseen), the Customer has the option to request the temporary suspension of the subscription, for a maximum period of three (3) months. The request for suspension shall be in writing addressed to Equiconnexion.

Article 17 : Report
On presentation of a medical certificate of incapacity for an extended period of time to the sport, dated less than 30 days (pregnancy, accident, prolonged illness, etc), the Client may request a postponement of its support on 52 weeks maximum.

Article 18 : Transition of face-to-Face at Distanciel and vice versa
, the Customer has the option of passing sessions face-to-face sessions in distanciel, or vice versa, in the case of relocation, personal or professional, or any other situation justifying it. The change of modality (face-to-face or distanciel) must be requested in writing to Equiconnexion and validated according to availability and logistical conditions.

Article 19 : Places are Limited and a Selection of
seating for the side dishes offered by Equiconnexion are limited and may be subject to a selection. Equiconnexion reserves the right to refuse the registration of a Client if their profile does not match the criteria defined for the accompanying programs. In this case, the Customer will be informed of the decision and, if fees have been paid, these will be refunded. A list ofwaiting can be put in place for candidates whohave not been retained, allowing them to benefit fromthe opportunity ofinscription if a place becomes available at a later time.

Article 20 : the Respect of the Rules of Procedure
The Customer declares to have taken knowledge of the rules of procedure provided in the contract is signed or sent by e-mail. In the event of non-respect of the rules of procedure, the Customer may terminate the contract and be liable for all of the remaining amounts to be charged for the subscription term remaining. Such termination shall be effective after a prior warning.

Article 21 : Acceptance of terms and conditions and Final Provisions
these General terms and Conditions of Sale (GTC) are a contractual framework between Equiconnexion and the Client. The fact that the Client subscribe to one of the support formulas proposed implies full acceptance without reserve of all the provisions of these terms and conditions.

In case of modification of the terms, the new provisions will be brought to the knowledge of the Customer and will be applicable to new subscriptions, without retroactive effect on existing contracts. The Customer recognizes having been aware of terms and conditions in their entirety prior to your purchase, and agrees to abide by their terms.
